Enacted in July 2025, Law 5218/2025 introduced major amendments to Law 4412/2016, affecting both preparation/award stages and precontractual legal protection.
Key Preparation & Award Amendments
- Abolished mandatory ESIDIS usage for direct awards between €30,000 and €60,000 to lower bureaucratic burden while maintaining publicity on KIMDIS.
- Recognized conformity assessment bodies established in non-EU countries under EA MLA, ILAC, or IAF MRA agreements.
- Reorganized self-cleaning examination into two thematic committees.
- Mandated publication of the entire tender notice on DIAVGEIA.
- Repealed clauses allowing arbitrary modifications of contractual quantities without review clauses.
Legal Protection Amendments
- Shortened HSPPA assent deadlines for negotiated procedures (from 20 to 10 days).
- Established a strict 25-page limit for prejudicial appeals filed before HSPPA.
- Deadline to challenge tender notices set strictly at 15 days from KIMDIS publication.
- Increased judicial appeal fees from 0.1% to 0.5% of estimated contract value (cap raised from €5,000 to €30,000).
